POLICY <br /> <br />The policy of the Surprise Police Department is to respond to all calls of <br />domestic violence. When violence has occurred or been threatened, the primary <br />responsibility of the responding officers is to investigate a crime. Officers shall <br />conduct detailed investigations to include victim/witness interviews and evidence <br />collection, and shall follow the protocol established by the Maricopa County <br />Attorney’s Office. If the preliminary investigation establishes probable cause that <br />domestic violence has been committed and physical violence, injury, or threats of <br />bodily injury have occurred, officers are mandated by this policy to make a <br />physical arrest. <br /> <br />II. DEFINITIONS <br /> <br />A. Domestic Violence (as defined in ARS Title 13, Chapter 36, Family <br />Offenses) involves any act which is an offense as defined below in section <br />B, when: <br /> <br />1. The relationship between the victim and the defendant is one of <br />marriage or former marriage or of persons residing or having <br />resided in the same household. <br />2. The victim and the defendant have a child in common <br />3. The victim or the defendant is pregnant by the other party. <br />4. The victim is related to the defendant or the defendant's spouse by <br />blood or court order as a parent, grandparent, child, grandchild, <br />brother or sister or by marriage as a parent-in-law, grandparent-in- <br />law, step-parent, step-grandparent, step-child, step-grandchild, <br />brother-in-law or sister-in-law. <br />5. The victim is a child who resides or has resided in the same <br />household as the defendant and is related by blood to a former <br />spouse of the defendant or to a person who resides or who has <br />resided in the same household as the defendant. <br /> <br />B. The following acts constitute domestic violence offenses: <br /> <br />1. Dangerous Crimes Against Children (ARS 13-705) <br />2. Endangerment (ARS 13-1201) <br />3. Threatening or Intimidating (ARS 13-1203) <br />4. Assault/Aggravated Assault (ARS13-1203 and ARS 13-1204) <br />5. Custodial Interference (ARS 13-1302) <br />6. Unlawful Imprisonment (ARS 13-1303) <br />7. Kidnapping (ARS13-1304) <br /> <br />
