<br />I. POLICY
<br />
<br />The Surprise Police Department has implemented this procedure to identify and
<br />react to bias crimes. This response has been developed in accordance with the
<br />guidelines established by the Federal or State "Hate Crimes Statistics Act of
<br />1990."
<br />
<br />II. DEFINITIONS
<br />
<br />A. Bias Crime: A bias crime or hate crime is a criminal offense committed
<br />against a person or property that is motivated in whole or part, by the
<br />offender’s bias against the victim’s race, religion, ethnicity/national origin
<br />group, or sexual orientation group.
<br />B. Bias: A pre-formed negative opinion or attitude toward a group of persons
<br />based on their race, religion, ethnicity/national origin, or sexual orientation.
<br />C. Disability Bias: A pre-formed negative opinion or attitude toward a group
<br />of persons based on their mental or physical disability.
<br />D. Discrimination: Discrimination is when a prejudicial thought is put into
<br />action.
<br />E. Ethnic/National Origin Bias: A pre-formed negative opinion or attitude
<br />toward a group of persons of the same race or national origin who share
<br />common or similar traits, languages, customs, and traditions.
<br />F. Gender Bias: A pre-formed negative opinion or attitude toward a group of
<br />persons based on their gender.
<br />G. Prejudice: An unreasonable and unjustifiable negative attitude toward a
<br />group and its individual members.
<br />H. Racial Bias: A pre-formed negative opinion or attitude toward a group of
<br />persons who possess common physical characteristics genetically
<br />transmitted by descent and heredity which distinguish them as a distinct
<br />division of humankind.
<br />I. Religious Bias: A pre-formed negative opinion or attitude toward a group
<br />of persons who share the same religious beliefs regarding the origin and
<br />purpose of the universe and the existence or nonexistence of a supreme
<br />being.
<br />J. Sexual Orientation Bias: A pre-formed negative opinion or attitude toward
<br />a group of persons based on their sexual attraction toward and
<br />responsiveness to, members of their own sex or members of the opposite
<br />sex.
<br />K. Responding Officer: The first law enforcement officer on the scene who
<br />must determine whether a suspected bias incident has occurred.
