<br />I. PURPOSE
<br />
<br />The purpose of this directive is to establish policy, procedures and minimum
<br />guidelines for the identification, documentation, control and disposition of
<br />physical evidence and non-evidentiary property (other than abandoned vehicles)
<br />collected by the Surprise Police Department.
<br />
<br />II. POLICY
<br />
<br />The policy of the Surprise Police Department is:
<br />
<br />A. To collect, receive, preserve, transport, store and dispose of physical
<br />evidence and non-evidentiary property in a standard and consistent
<br />manner.
<br />B. To properly identify, package and promptly deliver evidence/property to a
<br />departmental receiving/storage area or other appropriate facility.
<br />C. To obtain a detailed inventory reflecting receipt when evidence/property is
<br />turned over to other agencies.
<br />D. In cases of seizures with or without warrants, to ensure a return of all
<br />instruments, articles or items seized, or detailed inventory of such, before
<br />the court of applicable jurisdiction, the submitting officer(s)/ case
<br />detective(s) shall supply the property custodian with all necessary
<br />information regarding disposition of cases and property, which is not to be
<br />retained. Information shall be obtained by the Property Custodian.
<br />E. When practical, to provide a receipt describing the evidence seized or
<br />property received and to identify the seizing or receiving officer(s) to the
<br />person from whom the property was taken.

<br />III. RESPONSIBILITIES
<br />
<br />A. Officers will not solicit, accept or retain for their personal use any
<br />evidence or non-evidentiary property. Evidence or property, which
<br />is to be used for Department needs, will be obtained through court
<br />order or other legal means.
<br />B. Evidence Technician/Custodian Personnel will check incoming
<br />evidence/property for proper marking and packaging, maintain
<br />security of the evidence/property in Department custody, initiate
<br />and maintain required records and files and dispose of
<br />evidence/property in accordance with this or related directives.
<br />C. Officers are responsible for the security of evidence/property in
<br />their possession. Each item to be impounded will be numbered,
<br />marked for identification with as little defacement, or mutilation as
<br />possible, and described in detail on the property receipt. A police
<br />report will be filed with the appropriate evidence information
<br />contained within the report.
