<br />I. PURPOSE
<br />
<br />This addendum: Establishes policy and procedures governing the compensation
<br />of Department employees while attending court proceedings.
<br />
<br />II. POLICY
<br />
<br /> It is the policy of the Surprise Police Department to compensate its employees
<br />for overtime worked while participating in court related proceedings in
<br />accordance with City policy and the Fair Labor Standards Act (F.L.S.A.)
<br />
<br />III. DEFINITIONS
<br />
<br /> Court-related appearance will include the following:
<br />
<br />A. Grand jury appearances
<br />B. Pre-trial hearings
<br />C. Admin Per Se hearings
<br />D. Defense/ Prosecution Interviews
<br />E. Depositions
<br />
<br />
<br />IV. PROCEDURE
<br />
<br />A. Non-exempt employees, not serving on a tour of duty, shall be
<br />compensated for a minimum of two (2) hours of overtime for any court
<br />appearance.
<br />B. The Surprise Police Department does not authorize “stand-by” in lieu of
<br />appearance. Non-exempt employees who place themselves on “stand-by”
<br />with the prosecution or court, who are not required to appear, will not
<br />receive overtime compensation. If while on “stand-by” the employee is
<br />required to appear in court, they will be compensated for approved time
<br />only or two (2) hours minimum, whichever is greater.
<br />C. Non-exempt employees scheduled for court appearance less than two (2)
<br />hours immediately prior to their scheduled tour of duty, shall only be
<br />compensated for the time of appearance.
<br />D. If not required to appear before the court for the entire two (2) hours, non-
<br />exempt employees being paid for a court appearance are subject to being
<br />utilized at the direction of a supervisor to meet the needs of the
<br />Department during that two (2) hour paid period.
<br />E. Non-exempt employees required to attend court for longer than two (2)
<br />hours will be compensated for each additional hour worked. (Time will be
<br />rounded up to the one-quarter hour.)
<br />F. Employees shall complete and turn in all overtime slips on the same day
<br />or as soon as practical.
