<br />I. PURPOSE
<br />
<br />The purpose of this policy is to establish jurisdiction and authority for the
<br />Surprise Police Department.
<br />
<br />II. POLICY
<br />
<br /> The policy of the Surprise Police Department is to provide public safety service
<br />under the authority and within the constraints set forth by federal and state laws
<br />and municipal ordinances.
<br />
<br />III. PROCEDURE
<br />
<br />A. Jurisdiction and Authority (1.2.1)
<br />
<br /> 1. Pursuant to A.R.S. §9-240, the Surprise City Council has
<br />established the Surprise Police Department and thereby given it
<br />the authority to provide law enforcement services within the
<br />jurisdictional limits of the City of Surprise.
<br /> 2. Pursuant to A.R.S. §13-3871, the authority of an Arizona peace
<br />officer extends to any place in the State, with one exception. An
<br />officer may not stop a person solely based on reasonable suspicion
<br />of criminal activity outside of the jurisdiction without the prior
<br />consent of the chief law enforcement officer in the jurisdiction, or
<br />
<br /> 3. As required by Arizona law, in order to exercise the authority of a
<br />peace officer, a person must be certified by or exempted from
<br />certification by AZPOST. All Department sworn personnel shall be
<br />AZPOST certified.
