PURPOSE <br /> <br /> The purpose of this policy is to assist employees with the investigation of <br /> possession and/or manufacturing of marijuana in cases when people assert they <br /> are a medical marijuana patient, a designated caregiver, or a medical marijuana <br /> <br /> dispensary/dispensary agent. <br /> <br />II. POLICY <br /> <br />The policy of the Surprise Police Department is to enforce the conflicting federal <br />and state laws regulating medical marijuana giving priority to the supremacy of <br />the federal law while still giving as much effect as possible to the state statutory <br />exceptions for medical use. <br /> <br />III. DEFINITIONS (See generally A.R.S. 36-2801) <br /> <br />ADHS Arizona Department of Health Services. <br />Allowable Amount of Generally for a registered qualifying patient, 2.5 <br />ounces of usable marijuana (2.5 ounces is slightly <br />Marijuana <br />more than a soda can. The plants must be in <br />an enclosed, locked facility, unless the plants are <br />being transported because the caregiver is moving. <br />Caregivers may also be qualifying patients, adding <br />another 2.5 ounces or if they are authorized to <br />cultivate, twelve (12) plants. <br />Designated Caregiver A person with a valid registry identification card <br />licensed by ADHS to assist no more that (5) <br />qualifying patients with the medical use of marijuana. <br />Can do anything with patient’s marijuana that the <br />patient can do EXCEPT ingest. May receive <br />reimbursement for costs but no salary. <br /> <br />
