PURPOSE <br /> <br />The purpose of this policy is to establish procedures for the handling, packaging, <br />documentation, storage, control, and disposition of physical evidence and non- <br />evidentiary property collected/received by the Surprise Police Department. <br /> <br />II. POLICY <br /> <br />The policy of the Surprise Police Department is: <br /> <br />A. To ensure property and evidence is properly packaged, stored, and released <br />or disposed of in a timely manner. <br />B. To collect, receive, preserve, transport, store, and dispose of physical <br />evidence and non-evidentiary property in a manner that is in accordance with <br />Arizona Revised Statutes and Department policies. <br />C. To properly identify, package, and promptly deliver evidence/property to the <br />authorized departmental property and evidence receiving/storage locations, <br />or other appropriate facility to preserve the chain of custody. <br />D. When practical, to provide a receipt describing the evidence seized or <br />property received, and to identify the seizing or receiving employee/s to the <br />person from whom the property/evidence was taken. <br />E. To obtain a detailed inventory reflecting receipt when evidence/property is <br />turned over to other agencies. <br />F. In cases of seizures with or without warrants, to ensure a return of all <br />instruments, articles or items seized, or detailed inventory of such, before the <br />court of applicable jurisdiction, the submitting employee(s)/case detective(s) <br />shall supply the property technician with all necessary information regarding <br />disposition of cases and property, which is not to be retained. Information <br />shall be obtained by the property technician. <br /> <br />III. DEFINITIONS <br /> <br />TERM DEFINITION <br />Crime Gun Any firearm that is illegally possessed, used in a crime, or <br />suspected by law enforcement officials of having been used <br />in a crime or act of terrorism (as defined in the ATF NIBIN <br />MOU). <br />Dispose The transfer of property by its return to the owner, sale, <br />conversion, or destruction or by any other means of <br />disposal. <br /> <br /> <br /> <br /> <br />
