PURPOSE <br /> <br />The purpose of this policy is to establish procedures and guidelines for the <br />investigation of impaired drivers. <br /> <br />II. POLICY <br /> <br />It is the policy of the Surprise Police Department to identify and investigate <br />incidents of impaired driving whenever possible. This is done to reduce the <br />number of collisions resulting from impairment as well as to create a deterrent <br />effect, increasing the safety of the public. <br />III. DEFINITIONS <br />Admin Per Se/Implied The administrative form distributed to the Motor <br />Vehicle Division (MVD) used to notify a person of <br />Consent Affidavit <br />the requirement to submit to chemical testing as a <br />condition of operating a vehicle in the State of <br />Arizona while under investigation for DUI. <br />BAC Blood Alcohol Concentration <br />BrAC Breath Alcohol Concentration <br />Blood Collection Vial A vacuumed vial used for the collection of blood <br />that will be selected by the Phlebotomist <br />conducting a blood draw. <br />Motor Vehicle As defined by ARS 28-601 <br />Phlebotomist An Officer trained and certified or qualified to <br />obtain blood from an individual via a venipuncture <br />procedure. <br /> <br /> <br />IV. PROCEDURES <br /> <br />A. Driving Under the Influence (DUI) (61.1.11) <br /> <br />1. DUI provisions are covered under ARS Title 28, Chapter 4 as <br />follows: <br /> <br />a. 28-1381: Driving Under the Influence <br />b. 28-1382: Extreme Driving Under the Influence <br />c. 28-1383: Aggravated Driving Under the Influence <br /> <br />2.
